Terms of use
These terms govern the use of the Mishwar app and its website. Please read them with the privacy policy.

Mishwar is a technology platform that connects riders with independent taxi drivers. Mishwar is not a carrier and does not employ the drivers: the driver performs the ride in their own name and on their own account, and alone is responsible for their licences, vehicle, insurance and compliance with traffic law.
2. Acceptance
By creating an account, or requesting or accepting a ride, you accept these terms and the privacy policy in their published version. We record the number of the version you accepted and the date.
3. Account
- For people aged 18 and over; one account per person.
- The account is verified by a code sent by SMS or e-mail. Drivers also confirm their phone number.
- You give accurate information and keep it up to date, and you are responsible for the use of your phone, your mailbox and your account.
4. Requesting a ride
- You enter the pickup and destination; an estimated price is shown before you request.
- The request is offered automatically to the nearest available driver in the zone, then to the next one if it is not accepted within a short time.
- A request no driver accepts is cancelled automatically after 20 minutes. We do not guarantee that a driver is available at every time and place.
- The service is only available in the service zones (Tunisia, Greater Montréal), with the pickup and destination in the same zone.
5. Prices
- Tunisia: the price shown before requesting is an estimate based on the official individual-taxi tariff (day/night). The amount to pay is the meter amount, entered by the driver on arrival and shown on the receipt. No fee is added for the rider.
- Montréal: the maximum price, fees included, is shown and accepted before the request reaches a driver.
6. Payment
- Cash to the driver at the end of the ride, or with the Mishwar wallet where available.
- Card payment is not offered at the moment, and no card details are requested.
- A receipt is available in the app after every ride, and sent by e-mail if you switched that on.
7. Mishwar wallet
- Internal credit in Tunisian dinars, available in Tunisia only.
- It is topped up with Mishwar (cash or bank transfer); every top-up is recorded by an administrator and appears in the wallet history, which cannot be edited.
- It cannot be transferred to another user, earns no interest, and is neither a bank account nor an electronic payment instrument.
- To request a ride with the wallet, the balance must cover the estimated price; the ride amount is debited once, at the end of the ride.
- Before your account is deleted, the remaining balance is refunded on request.
8. Cancellation
- The rider may cancel free of charge until the ride starts.
- The driver may give up an accepted ride before it starts; it is then offered to another driver.
- There is no cancellation fee at the moment. Repeated or abusive cancellations may lead to suspension of the account.
9. Rider commitments
- Be at the pickup on time and give an accurate destination.
- Respect the driver and the vehicle, wear a seatbelt, and carry nothing illegal or dangerous.
- Pay the amount due at the end of the ride.
10. Driver terms
- Hold and keep valid every required licence (driving licence, professional card or taxi permit, registration, insurance) and update the documents in the app at each renewal.
- Receive rides only once Mishwar's team has accepted your documents, and only in your licensed zone.
- Tunisia: start the meter on every ride and enter exactly the amount it shows on arrival. Montréal: do not exceed the price the rider accepted.
- Share your position while receiving requests is switched on; before a request, nearby riders only see an approximate, anonymous position (see the privacy policy).
- Service fee: a percentage of each ride amount, set by Mishwar for each zone and shown on the earnings screen; any rate change is announced in advance. Amounts due are settled through the recorded settlements.
- Accept the billing mandate and vouch for the accuracy of your tax details.
- You alone remain responsible for your tax and social obligations.
11. Invoicing
Every completed ride gives the customer an invoice issued by Mishwar in the name and on behalf of the driver, under the billing mandate the driver accepts in the app. Each month Mishwar sends the driver the invoice of its service fee. Invoices are numbered continuously, never edited (a mistake is corrected with a credit note) and kept as long as accounting and tax law require.
12. Safety
- In an emergency call the emergency services: 197 (police) or 190 (ambulance) in Tunisia, 911 in Canada.
- “Share trip” sends live tracking to someone you trust.
- Report any incident to support@arj.digital; we may suspend an account while we look into it.
13. Ratings and chat
- After every ride, rider and driver can rate each other from 1 to 5 and leave a comment.
- The chat is only for the current ride and must stay respectful; for a complaint or for safety, the team may read the messages, which are kept for 6 months.
14. Suspension and closing the account
Mishwar may suspend or close an account for a breach of these terms, fraud, danger to others or invalid documents. You may delete your account at any time, in the app or on the Delete account page.
15. Liability
To the extent permitted by law, the platform is not liable for the acts of drivers or riders, or for interruptions caused by networks, GPS or phones. This limit does not apply to our gross negligence or to what the law requires.
16. Intellectual property
The app, the website, the Mishwar name and logo belong to Mishwar. Copying or modifying them, or trying to extract their code, is not allowed.
17. Complaints and disputes
Send complaints to support@arj.digital. An amicable solution is sought before any claim.
Rides in Tunisia: Tunisian law and the competent Tunisian courts. Rides in Québec: Québec law, without depriving consumers of the protection of the Consumer Protection Act.
18. Changes
These terms may change. We announce any important change in the app and ask you to accept the new version; if you refuse it, you can stop using the service and delete your account. The applicable version is the one published on this page.
